Trademark Disputes

Trademark disputes can happen for a variety of reasons. Our intellectual property legal team is experienced in all forms of legal proceedings when it comes to TM disputes. There are two avenues for disputing the usage of a TM:

1. Trademark Trial and Appeal Board: Part of the USPTO, the Trial and Appeal Board will hear cases involving the opposition of a pending mark, the cancellation of a registered mark, or the opposition of your registered mark by someone else.
   
   
2. State and Federal Court: Like the Trial and Appeal Board, a person may approach a state or federal court to block or cancel a particular registration. But unlike the USPTO, the courts have more expansive powers that include injunctions on your behalf, or the awarding of monetary settlements on your behalf for someone using your intellectual property.
